On August 17, 2006, the Chinese Ministry of Agriculture (MOA) through the General Administration of Quality Supervision, Inspection and Quarantine of People’s Republic of China (AQSIQ) announced it would suspend U.S. poultry products from the State of Pennsylvania. Announcement 703 indicates the ban came as a result of an occurrence of H5N2 low-pathogenic avian influenza (LPAI) discovered in a Pennsylvania bird market on July 12, 2006. Poultry meat and products produced or shipped from Pennsylvania after June 21, 2006 shall be returned or destroyed. The announcement is effective August 18, 2006.

Ministry Announcement from the Ministry of Agriculture of People’s Republic of China

H5N2 sub-type low-pathogenic avian influenza occurred in poultry market in Pennsylvania, USA, on July 12th 2006. For the purpose of preventing the avian influenza from entering China and to safeguard the safety of animal husbandry in our country, the following announcement is hereby made in accordance to relevant laws and regulations of China, including “Quarantine Laws on Animals and Plants Entering and Exiting People’s Republic of China”:

  1. It is prohibited to import poultry and its products directly or indirectly from Pennsylvania, USA. It is terminated to issue the “Quarantine License of Animals and Plants Entering China” for the poultry and its products imported from Pennsylvania, USA

  2. The poultry and its products arrived or shipped from Pennsylvania, USA after June 21s t 2006 (including June 21s t) shall be returned or destroyed. The poultry and its products arrived or shipped from Pennsylvania, USA before June 21s t 2006 shall be given customs clearance only after passing the avian influenza inspection.

  3. The poultry and its product from USA mailed or brought by travelers shall be prohibited to enter China, and shall be returned or destroyed when found.

  4. Poultry and its products from USA on transportation tools such as ships, airplanes and trains on international voyages passing or staying in China shall be kept in custody after sealing; the poultry bred and used by the transportation tools shall be kept in cages completely, with their wastes undergone harmless treatment under the supervision of inspection and quarantine institutions for goods entering China. No unapproved disposal allowed.

  5. Such poultry and its products from USA found to enter China illegally should be destroyed under the nearby inspection and quarantine institutions for goods entering and exiting China.

  6. Any person breaching above-said regulations shall be handled in accordance with relevant regulations prescribed in “Quarantine Laws on Animals and Plants Entering and Exiting People’s Republic of China”.

  7. Each inspection and quarantine institutions for goods entering and exiting China, as well as animal quarantine and supervision institutions of each level shall cooperate with the quarantine, inspection and supervision work closely, in accordance with the “Quarantine Laws on Animals and Plants Entering and Exiting People’s Republic of China” and “Epidemic Prevention Laws on Animals of People’s Republic of China”.

The announcement is effective from the issuing day on.
