A Final Blow for Tyson Antibiotic Claims

US - Tyson's latest appeal to block an order barring them from advertising poultry products as antibiotic free has been refused.

According to the Examiner, a federal appeals court has refused to block an order barring Tyson Foods from advertising that its poultry products don't contain antibiotics thought to lead to drug resistance in humans.

Tyson says it is weighing its legal options and continues to believe it has acted responsibly. The company says it is not currently running any advertisements and is working with stores to remove marketing materials by the May 15 deadline set by a federal judge in Baltimore.

The Fourth Circuit Court of Appeals in Richmond, Virginia, denied on Wednesday a motion by Tyson to stay the order pending appeal. The Springdale, Arkansas, food giant had asked the court to stay the ruling by the Baltimore judge, who issued a preliminary injunction last week.
