Banham Poultry clears the air with dispute settlement

UK - Norfolk based Banham Poultry has reached agreement with Breckland Council to resolve a long-running legal dispute over an odour abatement notice served against the company in April 2003.

The council now accepts that the company’s £200,000 programme of works at its Station Road processing site in Attleborough has proved successful in controlling odour, and has agreed to withdraw its original abatement notice.

Banham has consequently withdrawn its appeal and will pay £12,340 towards the council’s legal costs as a goodwill gesture.

Banham Poultry’s appeal was due to be heard later this month at King’s Lynn Magistrates’ Court. Both parties agree that settlement would avoid the need for further costly court proceedings over an issue that had been resolved.
